SHA Whistleblower Awarded €5,000 by A French Court Against Tycoon Saini
Healthcare entrepreneur Jayesh Saini had earlier, through a French court, filed a defamation case against Paris-based Kenyan activist, Nelson Amenya.
Saini accused Amenya of defaming him and his businesses through some X posts. Amenya’s posts showed alleged irregularities in contracts related to the transition from the National Health Insurance Fund (NHIF) to the Social Health Authority (SHA).
The French court shielded Amenya citing protections under European Union laws on freedom of expression. Judge Francois Hary said posts addressed matters of public interest in Kenya’s healthcare sector and there’s no evidence to prove harm to Saini’s reputation or his businesses in France. He also ordered Saini to pay €5,000 (Ksh 667,000) to cover Amenya’s legal fees and other expenses incurred while defending the suit.
Saini filed a similar defamation case with Chief Magistrate’s Court in Milimani, Nairobi which is active. Saini legal battle against activist Amenya are far from over, over the same X posts on SHA.
